These Rules and Regulations set out the rules of making purchases in the online shop run by the Seller at: www.polprofili.com.
The Seller is POLPROFILI Paweł Kłosowicz with office in Poznań at ul. Białośliwska 21, 60-418 Poznań.
The activity is carried out in the form of sole proprietorship, subject to entry in the Central Registration and Information on Business, NIP number: 783-000-83-07, REGON number: 632503269, also alternatively referred to as the "Service Provider".

1. Rules and Regulations - these Rules and Regulations. With regard to services provided on-line, the Rules and Regulations are those referred to in Article 8 of the Act of 18 July 2002 on the Provision of On-line Services (Journal of Laws of 2002 No. 144, item 1204 as amended).
2. Customer (Buyer) - a natural person who is at least 13 years old, however, if the person is under 18 years of age, the consent of his/her legal representative shall be required, as well as a legal person and an organizational unit that is not a legal person, to which special provisions grant legal capacity, and which makes or intends to place an Order or use other services of the On-line Store (including the Consumer).
3. Subject of the transaction - Goods listed and described on the website of the On-line Store. The Seller makes every effort to keep the offer presented on the website up to date. However, if some of the Ordered Goods are not available, the Seller undertakes to immediately inform the Buyer about the situation by phone or e-mail.
4. Product/Article - a movable item, which is covered by the Sales Agreement.
5. Sales Agreement - an agreement for the sale of Products within the meaning of the Civil Code Act, concluded between the Service Provider and the Customer, using means of remote communication (including telephone).
6. Polprofili On-linet Store - an Internet service available at www.polprofili.com, through which Customers can buy the Products.
7. Party - Service Provider and Customer.
8. Store Website - each page or subpage of the website located at www.polprofili.com.
9. Order - a declaration of intent by the Customer specifying unambiguously the type and quantity of the Products, aimed directly at the conclusion of a Distance Sale Agreement via the On-line Store.
2. ORDERING OF GOODS
a) Placing an Order in the On-line Store by the Buyer shall be contingent upon the Buyer reading these Rules and Regulations and accepting their provisions during the processing of the Order.
b) Polprofili sells goods ordered through the on-line store and in writing: sent to firstname.lastname@example.org. Orders are processed by economic operators: POLPROFILI, IMPERPOL, IMPOL and TOP
c) Customers can place orders 7 days a week, 24 hours a day.
3. PLACING ORDERS IN THE ON-LINE STORE
a) All prices cited on the www.polprofili.com website are net prices in Euros (excluding VAT). The prices do not include shipping costs.
b) Orders are accepted through the www.polprofili.com website.
c) The product range of the On-line Store is divided into categories according to the type of Products.
d) Each Item has a unique commodity code. The description of the product includes information on its properties, price and raw material.
e) In order to add a given Item to your cart, you need to enter the appropriate number of Items of the Product and then click the "Add to cart" button.
f) After the Product has been correctly added to the cart, the current order status will appear on the left side of the screen. It is possible to continue shopping or go to the basket to confirm the order.
g) After completing the order, click the "Buy" button.
h) The Customer may modify the order placed (e.g. change the quantity or remove Products). The selected item can be deleted by clicking "Delete".
i) The next step is to choose the payment method and delivery method.
j) The Customer has a choice of two ways of making purchases:
· quick shopping without logging in
· shopping with login, after registration. The Customer gains access to additional options such as: order history, customer data, shipping address.
k) Please complete the data form of the ordering person/company and the delivery address (if different from the above).
l) The Buyer agrees to issue and send electronically, to the e-mail address indicated by him, an electronic image of the billing documents, in particular such as: VAT invoices with attachments, correcting VAT invoices with attachments and forms. This consent also authorises the Seller to issue and send VAT invoices in electronic form, in accordance with the Regulation of the Minister of Finance of 17 December 2010 on sending invoices in electronic form, the rules of their storage and the procedure for making them available to the tax authority or tax inspection authority.
m) The “Comments” field is used to provide additional relevant information to the store staff.
n) The Customer places an order by selecting the "Buy" button at the bottom of the screen.
o) At any stage of order placement, however, before selecting "Buy", the Customer can cancel it by stopping the next steps and leaving the order page. This can be done in several ways: e.g. by clicking on the icon used to return to the previous page, or by going to any subpage or Product on the store's website. An order that is not completed by the Customer will be automatically cancelled.
p) After placing an order, a confirmation of a successful transaction will appear on the screen.
q) A confirmation of acceptance of the order for processing will be sent to the e-mail address provided by the Customer.
4. AVAILABILITY OF GOODS
All products in the offer of POLPROFILI are available.
In case the number of ordered Items is higher than the current stock, the Customer shall be informed immediately by e-mail or telephone about the extended order processing time.
If a later date of order completion is not satisfactory for the Customer, he/she has the right to cancel the whole or part of the order.
5. LEAD TIME
a) In the event of payment by bank transfer, the ordered products are sent within one working day from the date of delivery to email@example.com of the transfer confirmation.
b) Orders placed on working days before 12:00, with cash on delivery, will be sent the same day. Orders placed after 12:00 will be sent the next business day.
c) Personal collection of goods directly from our warehouse is possible in Poznań from 07:30 to 15:30. The stationary store serves only economic operators.
6. FORM OF PAYMENT FOR THE ORDER
The Customer may choose the following payment methods for the ordered Products:
a) Cash on delivery: payment is made on receipt of the consignment
b) Prepayment to a bank account: transfer in the amount of the order value together with the possible cost of transport to the bank account number indicated on the invoice.
c) Term transfer (14 days) for regular customers
d) Term transfer (contractual deadline) for Customers bound by a commercial cooperation agreement
Information on the form of payment is included in the invoice.
a) The Seller makes Deliveries in the territory of the Republic of Poland.
b) Ordered Items are delivered to the address indicated in the order, also directly to the construction site.
c) Delivery costs in Poland:
· in case of payment by bank transfer - PLN 17 net
· in case of cash on delivery payments - PLN 27 net
d) Zamówienie o wartości co najmniej 700 zł netto, zostanie wysłane do Klienta na koszt Polprofili.
e) Products are delivered using the DHL courier service.
f) It is possible to ship the purchased Products outside the country. In this case, the type of forwarding and the cost of transport is determined individually.
8. WITHDRAWAL FROM THE AGREEMENT
a) A consumer who has concluded an agreement by remote means shall be entitled to withdraw from the agreement without giving any reason by making a written declaration to that effect. However, this right is limited in time and may only be exercised within 14 days (legal basis: Article 27 of the Consumer Rights Act of 30 May 2014). This is a strict time limit and is counted from the date of delivery of the goods and, where the agreement concerns the provision of a service, from the date of its conclusion. To meet this deadline, it is sufficient to send a statement before its expiry.
b) The law referred to in this paragraph applies to consumer sales, and thus applies only to sales to an individual who makes a purchase for purposes which are not related to his or her professional or business activity.
c) Goods returned in this mode shall be accepted only if they are intact and the Product itself and its accessories are undamaged and do not bear signs of use, indicating a different use of the product than just in ordinary management, in particular by checking the conformity of the goods with the order.
d) If the right of withdrawal is exercised, the returned goods must be sent back at the Buyer’s own expense to the Service Provider's business address.
e) The return shipment must be accompanied by a written statement of withdrawal from the agreement and the account number to which the store is to return the payment.
a) Any person placing an order has the right to lodge a complaint.
b) If the complaint is considered justified, the Buyer has the right to demand replacement of the damaged Product at no additional cost.
c) If the store is unable to replace the defective Product, the Buyer may demand an appropriate price reduction or withdraw from the agreement.
a) The controller of personal data provided by the customers of the on-line store in connection with purchases is the Service Provider.
b) The Service Provider makes every effort to ensure that your privacy is respected and your personal information is protected when you use the Website and make purchases through the store and takes all necessary steps to this end.
c) During purchases and registration, the Service Provider collects the following data: first and last name, mailing address, e-mail address, telephone, company name, etc. These data are provided on a voluntary basis but are necessary for the provision of the service.
d) Personal data shall be used for the purpose of performing sale agreements and may therefore be transferred to entities responsible for delivering the purchased goods to the customer and, in the case of hire purchase, to the institutions crediting the purchase.
e) Customers have the right to access and correct their data.
11. FINAL PROVISIONS
a) In matters not regulated by these Rules and Regulations, the provisions of the Consumer Rights Act of 30 May 2014, the Act of 27 July 2002 on Special Conditions of Consumer Sales and on the Amendment to the Civil Code (Journal of Laws 2002 No. 141 item 1176 as amended), the Act of 23 April 1964. - Civil Code (Journal of Laws 1964 No 16 item 93 as amended) shall apply.
b) Disputes arising from the application of these Rules and Regulations and in connection with the performance of agreements concluded between the Store and Customers, shall be considered by the Court having jurisdiction over the Service Provider's registered office in accordance with the Code of Civil Procedure Act of 17.11.1964 (Journal of Laws No. 43 item 296 as amended).
c) The Service Provider reserves the right to amend these Rules and Regulations, with the proviso that the version of the Rules and Regulations in effect at the time of order placement by the Customer shall apply to agreements concluded prior to the amendment.
d) DATE OF PUBLICATION OF THE RULES AND REGULATION: 25 May 2018.
